Terms of Service

These Terms of Service govern the use of the Promptare.ai website and the creative production services offered by Devid Giurlani, owner of Promptare.ai (“Promptare”, “we”). By using the site or commissioning a service, you fully accept these terms.

1. Nature of the Service

Promptare.ai is a creative production service that uses generative AI tools under human creative supervision to produce visual content — videos, images, animations and related materials — commissioned by private and business clients. Promptare.ai does not develop AI models, sell AI software, or distribute chatbots or autonomous agents.

2. Service Delivery

Services are delivered on a project basis, according to a brief agreed with the client. Scope, delivery timelines, and costs for each project are defined case by case before work begins, and formalized through written communication (email or shared document).

3. Intellectual Property of Delivered Content

Upon project completion and full payment of agreed fees, ownership of the final content delivered to the client transfers entirely to the client. The client may use, modify, and distribute the delivered content without further authorization from Promptare, unless otherwise agreed in writing.

4. Client-Provided Material

The client guarantees they have the right to use and provide Promptare with any material (images, logos, text, trademarks) necessary for producing the commissioned content. Promptare is not liable for third-party rights infringement arising from material provided by the client.

5. AI Content Transparency

All content produced by Promptare.ai is created with the support of generative AI tools, in compliance with EU Regulation 2024/1689 (AI Act). The client is informed that delivered content is AI-generated and agrees to comply with any transparency obligations under applicable law at the time of publication or distribution of such content.

6. Payments

Payment terms and timelines are agreed for each project upon acceptance of the quote. Promptare reserves the right to suspend work in case of non-payment according to agreed terms.

7. Revisions and Changes

The number of revisions included in each project is defined at the time of agreement. Change requests outside the original brief may incur additional costs, to be agreed with the client in advance.

8. Limitation of Liability

Promptare is committed to providing a professional and accurate service, but does not guarantee specific commercial outcomes (e.g. sales increase, conversions, leads generated) resulting from the use of produced content. Promptare is not liable for indirect or consequential damages arising from the use of delivered content.

9. Self-Service Platform (Coming Soon)

Promptare.ai is developing a self-service platform that will allow clients to independently produce AI content. Access to this platform will be governed by specific terms of service, published at the time of beta launch.

10. Governing Law

These Terms of Service are governed by Italian law. Any dispute shall fall under the jurisdiction of the owner’s place of business, unless otherwise required by mandatory law.
