Promptare.ai (“Promptare”, “we”) respects your privacy and is committed to protecting the personal data you share with us. This page explains what data we collect, how we use it, and what rights you have, in accordance with Regulation (EU) 2016/679 (GDPR). As an EU-based company, GDPR applies to how we handle your data regardless of where you or your business are located.

1. Data controller

The data controller is Devid Giurlani, owner of Promptare.ai (VAT number IT06318820484), based in Italy. For any request regarding the processing of your data, you can write to contact@promptare.ai.

2. What data we collect

We collect personal data in the following cases:

Direct contact by email or form. When you write to contact@promptare.ai or fill out the request form on the site, we collect your email address, name, company name if provided, and the content of your message.

Platform waitlist sign-up. When you leave your email to be notified of the beta launch, we collect only your email address through the Web3Forms service.

Client service delivery. If you become a Promptare client, we collect the contact details and materials you provide for the production of the commissioned content. When a work call is recorded and transcribed for project organization purposes, that content falls under the same processing.

Client platform account. Once the Promptare.ai platform is live, creating an account will require an email address, name, and the data needed to manage your subscription and credits.

Browsing data. Like most websites, we collect anonymous, aggregated traffic data through statistical analytics tools.

3. How we use your data

We use the data we collect exclusively to:

— Respond to your requests and manage business communication

— Notify you of the platform launch, if you joined the waitlist

— Produce the commissioned content and manage the relationship with active clients

— Manage your account and credits on the client platform, once available

— Understand and improve the user experience on the site, in aggregated and anonymous form

We do not sell, rent, or share your personal data with third parties for marketing purposes. We do not use the material you share with us to train AI models of our own. For how individual third-party providers we use in production handle data, see section 7.

4. Legal basis for processing

We process your data based on your explicit consent (when you fill out a form or write to us), the performance of a contract (for clients commissioning a service), and our legitimate interest in responding to the requests we receive.

5. Data retention

We retain your personal data only for as long as necessary to fulfil the purposes for which it was collected, unless a longer retention period is required by law. Client data related to completed projects is retained for the period required by tax and contractual obligations.

6. Your rights

As a data subject, you have the right to:

— Access the personal data we hold about you

— Request its correction or deletion

— Object to processing or request its restriction

— Request data portability

— Withdraw your consent at any time

To exercise these rights, write to contact@promptare.ai. You also have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali) or, if you reside elsewhere in the EU, with your local supervisory authority.

7. Third-party services

To deliver our services, we rely on the following providers, which process data according to their respective privacy notices:

Web3Forms, for managing contact and waitlist forms

Supabase, for managing client platform accounts and data

Hostinger, for site hosting

FAL.ai, Higgsfield, HeyGen, ElevenLabs, AI generation tools used to produce commissioned content

Fireflies, for internal transcription of client work calls, solely for project organization purposes

Depending on their own terms of service and the subscription plan in use, some of these providers may use uploaded content to help improve their AI models. Where a provider offers an opt-out from this processing, we request and enable it. For projects involving material depicting real people, we assess on a case-by-case basis whether to use plans that include a contractual no-training guarantee.

8. International data transfers

Some of the providers listed in section 7 are based in the United States. Data transferred to these providers is carried out in compliance with the safeguards required under GDPR, through Standard Contractual Clauses approved by the European Commission or equivalent mechanisms adopted by the individual providers.

9. AI-generated content

The content we produce for our clients — images, videos, and other formats — is created using generative AI tools, always under human creative supervision. This processing concerns the commissioned visual material, not a systematic processing of clients’ personal data. Where AI-generated or AI-manipulated content is subject to the transparency obligations under Article 50 of Regulation (EU) 2024/1689 (AI Act), Promptare provides the necessary information accordingly. 10. Data security

We adopt appropriate technical and organizational measures to protect the data you share with us against unauthorized access, loss, or improper disclosure.

11. Changes to this policy

This Privacy Policy may be updated periodically. We encourage you to review it regularly. The date of the last update is shown at the top of the page.
